GENERAL INFO

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as “Buyer”) through slávica on slavicadesign.com website pursuant to Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods or Provision of Services under a Distance Contract. 

The Seller is: slávica, s. r. o., Kupeckého 18178/8, 821 08 Bratislava, ID No.: 48153621, VAT No.: 2120069655, registered in the Commercial Register of the District Court Bratislava I, Section: Sro, Insert No. 104169/B. 

The Buyer is: a consumer, i.e. a person who, when concluding and performing a consumer contract, does not act within the scope of his/her business activity of employment or profession. The Buyer must be at least 18 years old and not under guardianship. Purchases made by a business entity are governed by the Commercial Code No. 513/1991 Coll. 

ORDER AND CONCLUSION OF CONTRACT

1. Placing an order

Sending and payment of the order by the Buyer through the slavicadesign.com e-shop is considered as a proposal for the conclusion of a contract according to the Civil Code, based on the Seller's offer. The contract is concluded with the confirmation of the order by the Seller. The Seller is entitled to withdraw from the purchase contract until the moment of dispatch of the goods, in particular due to the unavailability of the ordered goods. We will inform you of any withdrawal immediately by e-mail sent to the address specified in the order. We are entitled to offer you a replacement, substitute items of the equal or higher quality and value, which you can order . If you do not wish to order the substitute items we will reimburse your payment.

2. Prices of items

All prices of products listed on the website are final*. The Seller is subject to VAT. The prices of the products do not include a delivery charge. For most locations, delivery varies form 5 – 25 € subject to the size of the order and the exact location. The cost of delivery is specified below as well as in the communication between the Buyer and the Seller before the conclusion of the contract. The final cost is clearly shows in the check-out process. 

*Please note that orders shipped outside of the EU may be subject to import duty and taxes to be paid at the point of delivery by the receiver.

3. Delivery

4. Payment methods

The Buyer is obliged to pay the price to the Seller for the ordered goods. Information about the payment method is specified in more detail in the Shipping and Payment section.

5. Delivery

The Seller shall deliver the goods to the Buyer within 30 days at the latest, unless the Seller informs the Buyer otherwise in the case of made-to-order products and the delivery time may be extended by agreement with the Buyer. The usual delivery time is 1 - 7 working days. 

6. Cancellations and returns

You have the right to cancel or return your purchases within a period of fourteen (14) calendar days after the day of delivery of the goods. The right to cancel the order does not apply to made to order items or product that have been personalised. Please return items undamaged and unused, with all original labels and tags intact. This means that the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on).

The possibility of return does not apply to: products made to order according to the special requirements of the consumer, goods enclosed in protective packaging that are not suitable for return due to health protection or hygiene reasons and whose protective packaging was broken after delivery.

You must inform us about the return within the fourteen (14) day period as outlined in section 5.1 above. After this, you then have an additional fourteen (14) day period to return the items to us. We will then provide a refund, attempting to use the same method that you used to make the payment. At the latest, the refund will be given within 14 days of receiving your notice of cancellation, as long as we have received and checked the state of the returned items. 

If the item you have received is faulty, please notify our customer service team by emailing eshop@slavicadesign.com as soon as possible and return the item in accordance with the advice of the customer service team. For any items that we do find to be faulty, we will either replace the item or provide a full refund within 14 days.

COMPLAINTS PROCEDURE

1. Right to complaint

If there is any defect in the purchased goods, the Buyer has the right to claim this defect upon receipt of the goods or within the warranty period. In order to assess the claim correctly, it is necessary that the items are complete, clean, in accordance with the hygiene regulations or general hygiene principles. The Buyer is obliged to use the items only for their intended purpose and to observe the known rules, conditions and instructions for use. The exercise of the right to claim shall apply only to defects not caused by the Buyer and defects excluding normal wear and tear of the product or material.

2. Place and method of complaint 

The Buyer shall make a claim by emailing eshop@slavicadesign.com. The handling of the complaint is entrusted to an employee who is obliged to forward the complaint for consideration. 

To assess the claim for defects in the goods, the Buyer is obliged to submit: 
- identification data of the Buyer, or telephone contact,
- proof of purchase of the goods,
- the name of the goods,
- the price of the goods,
- a precise description of the defect in the goods or how the defect occurred,
- the goods in the condition as specified in Art. 1.

On receipt of the complaint, the worker shall issue a document to the Buyer indicating the identification data of the Buyer, the date on which the complaint was made, what goods are being complained about, when the goods were purchased, at what price the goods were purchased, a brief description of the defect, stamped and signed by the complaint worker, which shall be sent to the specified contact email. 

Send the goods together with the proof of purchase to the address: slávica, s. r. o., Laurinská 19, 811 01 Bratislava. Postage or other costs of returning the goods in the event of a claim are borne by you as the Buyer. We do not accept returns by cash on delivery and we will not accept such shipment.

3. Liability of the Seller 

The Seller shall be liable for defects that appear in the goods during the warranty period, but not for defects:
- which are self-inflicted by the Buyer,
- of which the Buyer was aware before taking delivery of the goods,
- for which a discount has been granted on the price of the goods,
- which have arisen during the warranty period as a result of wear and tear of the goods, their improper or excessive use, improper care, improper servicing or after the expiry of their useful life,
- which have been caused by tampering by an unauthorised person on the goods or on a part thereof.

4. Warranty period

The Buyer has the right to claim for defects in the goods within 24 months of receipt of the goods by the Buyer. The Buyer has the right to make a claim for 24 months from receipt of the goods, unless a longer period is stated on the goods or in the warranty card. If a claim for defective goods for which the Seller is liable is not made within the warranty period, the right of liability for defects shall be extinguished. The processing of the claim shall not take longer than 30 days. This period shall begin on the date of the complaint by the Seller. 

5. Rights of the Buyer 

The Buyer has the right, in the case of remediable defects claimed within the warranty period, to have the defect removed free of charge, properly and in a timely manner. The Seller is obliged to remove the defect without undue delay. However, the Buyer should not continue to use the item on which the defect has been detected. Wear and tear characteristic of the material or use is not considered a defect. 

In the case of defects which cannot be remedied and which prevent the thing from being properly used as a thing without defects, the Buyer has the right to:
- to replace the item, or
- the right to withdraw from the contract and demand a refund of the purchase price. 

The Buyer has the right to choose.
